Family law, like many other areas of law, is in a constant state of change, and as lawyers we have a responsibility to our clients to keep abreast of such changes and aware of how they might impinge on a client's case.
By way of example, two cases that have recently been heard in the Higher courts initially seemed to suggest that a trustee in Bankruptcy could successfully seek an Order to over turn an earlier Order for financial settlement made in divorce proceedings.
However, there has been a significant development in that the earlier decision of the District Judge in the County Court was been overturned in the Court of Appeal at a hearing in November 2007, so that it would seem that trustees in bankruptcy may no longer expect to be able to overturn, on behalf of creditors of one of the parties to a marriage, Orders made for financial settlement in matrimonial proceedings.
It remains to be seen, however, whether the issue is further appealed to the House of Lords.
